The Minister of Public Works and Public Housing (Pekerjaan Umum dan Perumahan Rakyat/PUPR) has issued Regulation of the Minister No. 11/PRT/M/2019 on Preliminary Sales and Purchase Agreement System (Regulation 11/2019). Regulation 11/2019 replaces and repeals the previous regulations which regulate on Preliminary Sales and Purchase Agreement, namely Decree of the Minister No. 11/KPTS/1994 on Guidelines for Sales and Purchase Agreement for Strata Unit and Decree of the Minister No. 09/KPTS/M/1995 on Guidelines for Sales and Purchase Agreement for House.
According to developer point of view, Regulation 11/2019 is considered to be a burden for the developer since there are a lot of irrelevant articles, especially the regulation on marketing.
In essence, Regulation 11/2019 further regulates the provisions which are contained in Law No 20 of 2011 on Strata House and Law No 1 of 2011 on Housing and Residential Area which is aimed to optimize the regulation on Preliminary Sales and Purchase Agreement (Perjanjian Pengikatan Jual Beli/PPJB) along with its marketing methods.
In Regulation 11/2019, marketing may be conducted by the developer both before and during the signing of PPJB with the buyers. PPJB shall contain accurate information on planning and recent physical condition of the relevant property. The marketing activity may be conducted by the developer or marketing agent when the development is ongoing (applied to the marketing of a detached or semi-detached house) and prior to the development (applied to the marketing of strata house).
